CARBIS MILL – GUEST TERMS & CONDITIONS
These Terms and Conditions apply to reservations for accommodation in Corn Loft or River Cottage at Carbis Mill made via our website carbismill.co.uk.
Contract:
A contract between the Booking Leader and the owner will come into existence after payment is made and a confirmation of booking has been delivered. It is the responsibility of the Booking Leader to ensure that all members of the party are aware of and accept these terms and conditions.
Booking & Booking Deposit:
A non-refundable deposit of 25% of the holiday price is payable at the time of booking. Full payment must be made six weeks prior to your arrival.
Bookings made less than 6 weeks before your arrival date must be accompanied by the full payment.
If the balance is not received by the due date then your booking will be treated as a cancellation.
Bookings cannot be accepted from persons under eighteen years of age.
Cancellations:
We strongly advise that you take out comprehensive travel insurance. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.
All cancellations must be immediately notified in writing.
Deposits are non refundable. (See below if dates re booked).
Once the balance is paid it is non refundable. (See below if dates re booked).
Following a cancellation we will endeavour to re-let the accommodation, in the event your dates are re-let, you will be entitled to a refund payment, based on the period of stay re-let and reflecting any reduced price offered to obtain the re-let.
Your booking will not be cancelled by the owners unless exceptional circumstances occur that are beyond our control such as flood, fire damage, or other extreme weather conditions or external events. Notification will be given of the cancellation as soon as possible and we will promptly refund all payments made for your booking. Our liability for cancellation will be limited to payments made to us.
Guest Numbers:
Corn Loft and River Cottage are only let to guests to provide accommodation for two adults. The number of persons using the accommodation at any time must not exceed two adults. You may in no circumstance re-let or sublet the property, even free of charge, or use the accommodation for business purposes or entertainment event purposes without our express prior written consent.
NO OTHER PERSONS MAY STAY IN CORN LOFT OR RIVER COTTAGE OTHER THAN THOSE COMPRISED IN THE ORIGINAL BOOKING PARTY. THIS IS NOT A PARTY HOUSE VENUE AND ANY GUESTS VISITING DURING YOUR STAY SHOULD NOT BE ALLOWED TO STAY IN THE ACCOMMODATION OVERNIGHT. We reserve the right to immediately terminate the booking at any time without notice and without refund in the event of a breach of any of these conditions.
Owner Access:
The owners reserve the right to enter Corn Loft or River Cottage at any time to undertake essential maintenance.
Arrival & Departure:
Guests are welcome to check in from 3:00 PM unless otherwise agreed. The owners reserve the right to refuse to hand over accommodation or leave accommodation in the hands of any person who in a reasonable opinion may not be suitable to take responsibility of a property.
Guests are required to vacate the property by 10:00 AM unless otherwise agreed.
Cleaning:
Guests are responsible for leaving the accommodation in good order and in a clean condition. The convention for holiday accommodation is that guests are expected to leave the property in a similar state to which they find it. We reserve the right to make a further additional charge to cover cleaning costs if you leave the property in an unacceptable condition.
Fire risk assessment:
Smoking is not allowed inside Corn Loft or River Cottage, if guests smoke inside either of the properties they will liable to immediate termination of occupancy and forfeiture of all payments.
No candles or naked flames are allowed in Corn Loft.
Dogs:
Dogs are not allowed in Corn Loft.
Dogs are allowed in River Cottage.
We live in a rural area surrounded by fields with livestock. Dogs need to supervised and not allowed to roam freely at Carbis Mill.
Dogs need to be well-behaved and should not be left unattended inside River Cottage.
If damage is caused by dogs, guest may be billed for the cost of repairs or replacement.
River Cottage garden is not guaranteed as secure for dogs even though it is described as private and enclosed and therefore we advise that dogs should not be left unattended.
Damage:
In the event that you notice damage in your accommodation guests should notify us immediately.
If there have been any breakages during your stay guests should notify the owners and replace the items or pay for replacement.
Parking:
Onsite parking is provided for all guests. All parking is strictly at your own risk and the owners accept no liability for any damage caused to vehicles or loss of any contents.
Security:
While we live in a rural and safe location we advise that you lock the doors and close the windows when you leave your accommodation unoccupied.
Internet:
The internet connection is not guaranteed, it is provided by an antenna that receives a 4G signal from a mast. The signal can be affected by extreme weather conditions and technical faults. The internet access provided is intended for general use, It is not intended for High Definition streaming, online gaming, extensive downloads/uploads.
Liability:
Every effort is made to ensure that all equipment inside the accommodation is in working order. If we are notified of a fault we will endeavour to rectify the issue ASAP, there is no guarantee that will be achieved during your stay.
We shall not, however, be liable for any defect, failure, or malfunction of any equipment including plumbing, electricity, internet, howsoever arising, nor for any material loss, damage, additional expense or inconvenience directly or indirectly caused by such failure.
Children:
Children under 18 are not allowed to stay overnight in River Cottage or Corn Loft.
Carbis Mill is in a rural area with rivers, mill leets, open mine shafts, livestock and nearby farming activities. The accommodation has low level windows, spiral staircase, wood burners, footbridge, etc, the accommodation and surrounding area and grounds are not child-friendly.
If guests have friends with children visiting them all children under 18 must be supervised by their parents/guardians at all times to ensure their safety and advised to keep clear of any hazards on the premises including the River Hayle which adjoins the property.
Nuisance:
Corn Loft and River Cottage are both are situated within the Carbis Mill grounds, guests in each of these properties have come to enjoy the peace and relaxation offered by our rural location. Guests agree that they will be considerate of all other guests and the property owners and will refrain from any activities likely to adversely impinge on others’ privacy, peace, and quiet enjoyment of their accommodation. Where in our opinion, the behaviour of yourself or any guest in your party is impairing such peaceful enjoyment, comfort or health of other guests or property owners then we reserve the right to immediately terminate your holiday without compensation.
Complaints:
Any problem or complaint which you may have concerning your holiday or the accommodation must be immediately reported directly to us and we will endeavour to put matters right.
Force Majeure:
We cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.
Severability:
If any provision of this agreement shall be declared by any court of competent jurisdiction to be illegal, void, or unenforceable, the other provisions shall not be affected but shall remain in full force and effect.
Jurisdiction:
This contract shall be governed by the laws of England and Wales. Guests and the owners agree to submit to the exclusive jurisdiction of the English Courts and agree that the contract made between you and us is made at our premises and that any proceedings or disputes between us shall be conducted in the County Court nearest to us.
Insurance:
The owners have Public Liability insurance, please note breaching any of our terms and conditions may affect liability and any claims under this policy.
